As an employer in South Africa, you are responsible for deducting PAYE (Pay-As-You-Earn), UIF, and SDL from employees' salaries and paying these over to SARS monthly. Non-compliance with employer obligations attracts some of the steepest penalties in the tax system.

Director Personal Liability

Under Section 252 of the Tax Administration Act, a director or officer of a company can be held personally liable for PAYE, UIF, and SDL that the company failed to pay over to SARS. This means SARS can pursue the director's personal assets to recover the debt.

This personal liability applies when the director was responsible for the company's tax affairs or was negligent in ensuring compliance. It is one of the most serious consequences of employer non-compliance.

Monthly Compliance Checklist

Follow this checklist every month to stay compliant:

  • By the 7th — submit the EMP201 return via eFiling
  • By the 7th — pay the declared PAYE, UIF, and SDL amounts
  • Verify IRP5 data — ensure employee details and tax calculations are correct
  • Reconcile — check that the amounts declared match your payroll records
  • Bi-annually — submit the EMP501 reconciliation (April/May and October/November)
